Oil Industry Requests Extension Of Tier 3 Comment Deadline
EPA published a notice in the Federal Register on April 8, 2013, announcing a June 13, 2013, deadline for comments on its proposed "Tier 3" fuel and vehicle emissions rule. In March, EPA released the rule on its website available online. The rule has yet to be published in the Federal Register. Last week, the American Fuel & Petrochemical Manufacturers (AFPM) sent a letter to Robert Perciasepe, Acting EPA Administrator, requesting the deadline for comment on the rulemaking be extended until 90 days after it is officially published in the Federal Register. Refiners Continue Push To Repeal The RFS
Earlier this week, Charles Drevna, AFPM President, stated in an interview that the Renewable Fuel Standard (RFS) should be repealed. Last fall, the American Petroleum Institute announced that it had changed its position on the RFS from reform to repeal. As we have reported, these groups have taken action toward this end. EPA Proposes SNURs For Eight Renewable Chemical Substances
On April 18, 2013, EPA proposed significant new use rules (SNUR) under the Toxic Substances Control Act (TSCA) for eight chemical substances that were the subject of premanufacture notices (PMN) P-11-327, P-11-328, P-11-329, P-11-330, P-11-331, P-11-332, P-12-298, and P-12-299, the first six of which are renewable, biobased chemical substances manufactured by KiOR, Inc. Department Announces Support For Military Biofuels Projects
This week, DOE announced that it would provide up to $18 million to support four pilot-scale projects designed to produce drop-in biofuels that would meet military specifications for jet fuel and shipboard diesel, and could be for military or commercial use. Funding recipients are required to provide at least 50 percent in matching funds. U.S. House Energy And Commerce Committee Releases Second RFS White Paper And Comment Request
On April 18, 2013, the House Energy and Commerce Committee issued the second in an expected series of white papers issued by the Committee to "[set] out a number of emerging issues with the RFS." The topic of the first white paper was the blend wall. This second white paper addresses the impacts of the RFS on the agriculture sector, and largely stems out of the "food versus fuel" debate. Refiners Announce Limited Support For EPA’s RIN Fraud Proposal
Last week was the deadline to submit comments to the EPA on its proposal to prevent future instances of Renewable Identification Number (RIN) fraud. The proposal is intended to create a voluntary plan under which biofuels producers could have their RINs validated by a third party to help provide obligated parties (refiners) confidence in the validity of the RINs they may purchase to meet their renewable volume obligations under the RFS.
