Boxer Remarks On TSCA

Senate Committee on Environment and Public Works Chair Barbara Boxer (D-CA) recently made public remarks indicating her intent to move forward with efforts to reform the Toxic Substances Control Act of 1976 (TSCA). She has stated that she will hold a hearing on TSCA reform on July 31, 2013, and will focus on reaching consensus between S. 1009, the Chemical Safety Improvement Act of 2013, introduced in May by Senators David Vitter (R-LA) and the late Frank Lautenberg (D-NJ), and S. 696, the Safe Chemicals Act of 2013, introduced by Senator Lautenberg in April.

As we have reported, among other things, S. 1009 has been criticized for not including a provision that would provide EPA specific authority to implement key international treaties to control hazardous chemicals. The U.S. has signed onto, but the Senate has not yet ratified, the Stockholm Convention on Persistent Organic Pollutants (POP); the Rotterdam Convention on the Prior Informed Consent (PIC) Procedure for Certain Hazardous Chemicals and Pesticides in International Trade; or the POPs Protocol on Long-Range Transboundary Air Pollution (LRTAP). As the Senate considers S. 1009, a provision to provide EPA the authority it needs to implement the treaties so the U.S. may fully participate in them could be included by amendment.
