California Appeals Court Orders Fix To The State’s Low Carbon Fuel Standard

On July 15, 2013, the Fifth District Court of Appeals held in POET, LLC v. California Air Resources Board that the California Air Resources Board (CARB) violated the California Environmental Quality Act and the California Administrative Procedures Act by completing its rulemaking to implement the state's Low Carbon Fuel Standard (LCFS) before finishing its analysis of the program's environmental impacts, as required by state law. CARB and supporters of the LCFS are encouraged that the court did not enjoin the LCFS. Under the decision, CARB may continue to implement the LCFS, but must hold a new 45-day public comment period to receive input on the LCFS regulations, including CARB's calculation of indirect land use from the increased use of biofuels.
